3. Quotations & Contracts

All quotations are based on available information and site conditions at the time issued. Quotes are valid only for the stated period.

A contract is formed only when a quotation is accepted and confirmed by us in writing. We reserve the right to withdraw or amend quotations where conditions change.


4. Pricing & Variations

Quoted prices cover the listed scope only. Additional work requested by the client or required due to unforeseen site conditions will be treated as a variation and may be charged separately.

Examples include hidden ground conditions, access limitations, drainage problems, or previously undisclosed structures or services. Variations will be discussed before proceeding where reasonably possible.


5. Client Responsibilities

Clients agree to:

  • Provide safe and reasonable site access
  • Disclose known site constraints and underground services
  • Obtain landlord, neighbour, or authority permissions where required
  • Ensure working hours and access rights are permitted
  • Keep non-workers clear of active work areas

Delays caused by access or permissions issues may result in additional charges.


6. Materials & Installation

Material selections are agreed in advance. Natural materials such as stone, turf, soil, and timber may vary in colour, texture, or finish. This is not considered a defect.

Where specified materials become unavailable, we may offer suitable alternatives of similar quality and function.


7. Programme & Delays

Start dates and durations are estimates. Landscaping work is weather-dependent and may be delayed by adverse conditions, supply issues, or safety concerns. Such delays do not normally create liability for compensation.

We will communicate revised schedules where delays occur.


8. Payments

Payment terms are stated in the quotation or contract. Deposits and staged payments may be required.

We reserve the right to:

  • Pause work for overdue payments
  • Charge interest on late payments where lawful
  • Withhold completion or handover until paid

Materials supplied may remain our property until paid in full where stated in contract terms.


9. Cancellations

Cancellations must be made in writing. Clients may be charged for:

  • Work already completed
  • Materials ordered or delivered
  • Non-recoverable costs
  • Allocated labour time

Custom or special-order materials are generally non-refundable.


10. Warranties & Aftercare

Workmanship warranty periods, where offered, will be stated in writing. Warranties exclude:

  • Normal settlement and bedding-in
  • Weather damage or misuse
  • Lack of maintenance
  • Third-party interference

Living elements such as turf and plants depend on watering and care and cannot be guaranteed beyond initial establishment guidance.


11. Limitation of Liability

To the fullest extent permitted by law, liability is limited to the value of the contracted works. We are not liable for indirect or consequential loss, including loss of use, enjoyment, or profit.

Nothing excludes liability for death or personal injury caused by negligence or where exclusion is not legally permitted.


12. Privacy Policy

We collect personal data to:

  • Respond to enquiries
  • Prepare quotations
  • Deliver services
  • Maintain project and accounting records

Data may include names, addresses, phone numbers, emails, and property details. Data is stored securely and not sold to third parties.
